COURT REVERSES FIELD ON NFL, COMCAST RULING

NFL Network on Tuesday scored a win over Comcast, as a New York State appellate court reversed an earlier ruling allowing the cable operator to shift the channel to a premium sports tier. The appeals court overturned the May 2007 ruling by a state Supreme Court justice, concluding that the original carriage agreements between Comcast and the NFL “are ambiguous with respect to the scope of the tiering provision,” adding that “neither party has established that its interpretation of the relevant contracts is correct as a matter of law.” In a 14-page judgment, the appellate court panel remanded the matter to the lower court, arguing that certain ambiguities in the language of the carriage agreements will have to be untangled before a final ruling can be handed down.
