Right out of the gate, President Joe Biden has identified two main priorities: fighting the Covid-19 pandemic and promoting inclusive economic recovery. These are difficult tasks by any measure, but fortunately, meeting another major challenge unites both goals: universal and affordable broadband.

Waiting. That’s the name of the game for those anticipating the DC Circuit’s decision on the Federal Communications Commission's Restoring Internet Freedom order repealing Title II rules for broadband. The case was argued on Feb 1, 2019, so the Court could hand down a ruling any day now. But regardless of whether the decision is uphold or overturn, Americans deserve action on network neutrality from Congress. Statutory permanence for internet openness is the only way to end the ongoing uncertainty shrouding the internet ecosystem due to ever-changing rules.

Privacy laws should treat companies at the internet edge the same as the internet service providers that are largely prevented from accessing these vast swaths of personal data. The task for Congress is to create a straightforward set of privacy rights and company obligations that applies across the internet continuum, enhancing consumer understanding and confidence.
