FCC Issues Temporary Waiver of Certain Lifeline Rules and Allows T-Mobile to Provide Service on Emergency Basis

The Federal Communications Commission takes emergency action to ensure continuity of Lifeline service for the Lifeline households formerly served by Q Link Wireless LLC prior to its suspension. Temporary Waiver of Weiss Bank Safety Rating for CAF II and RDOF

The Federal Communications Commission's Wireline Competition Bureau (Bureau) partially waived, on one's own behalf, the requirement that a bank issuing a letter of credit (LOC) to a support recipient for either the Connect America Fund Phase II Auction (Auction 903) or the Rural Digital Opportunity Fund Auction (Auction 904) maintain a Weiss bank safety rating of B- or better.  This limited waiver only applies to banks that previously issued LOCs to Auction 903 or 904 support recipients, and therefore previously had a Weiss bank safety rating of B- or better.

Affordable Connectivity Program to End Soon Barring Congressional Action

The Federal Communications Commission's Wireline Competition Bureau (Bureau) announced requirements and guidance for the wind-down of the Affordable Connectivity Program (ACP).  The FCC currently projects that the last month for which the ACP can fully reimburse providers for the ACP benefits provided to enrolled households is April 2024. Should Congress not appropriate additional money, the existing funds will be exhausted, the FCC will have to end the ACP, and providers will stop providing discounts to enrolled households.

FCC Adopts Procedures to Implement Enhanced A-CAM

On July 23, 2023, the Federal Communications Commission adopted the Enhanced A-CAM Order, establishing the Enhanced Alternative Connect America Cost Model (A-CAM) program as a voluntary path for supporting 100/20 Mbps broadband deployment throughout the rural areas served by carriers currently receiving A-CAM support and in areas served by legacy rate-of-return support recipients.

FCC Extends Pause of Lifeline Phase-Out and Mobile Data Increase

The Federal Communications Commission's Wireline Competition Bureau (Bureau) extended, for an additional year, the waiver pausing both the phase-out of Lifeline support for voice-only services and the increase in Lifeline minimum service standards for mobile broadband data capacity. Without this decision, support for services that meet only the voice minimum service standard, which currently stands at $5.25 per month, would be eliminated in most areas on December 1, 2023.

FCC Issues Limited Lifeline Waiver

The Federal Communications Commission's Wireline Competition Bureau (Bureau), on its own motion, grants a limited, one-time waiver to a limited number of Lifeline subscribers who received incorrect information about the deadline for recertifying their eligibility for the Lifeline program. Specifically, in letters from the Universal Service Administrative Company (USAC), these subscribers were informed that they had approximately 80 days in which to recertify their eligibility for the Lifeline program, rather than the 60-days provided for under the Lifeline program rules.
