A comparative study of digital equity plans of four large US cities

The term digital equity is at the forefront of municipal government planning to mitigate digital equity. Digital equity signifies a desired future to be achieved, yet its meaning is not well-established. As such, planning for digital equity offers an opportunity for new discursive construction. This study examines how municipal governments have constructed the concept of digital equity through textual evidence, the digital equity plans of Kansas City (MO), Portland (OR), San Francisco (CA), and Seattle (WA). Adopting an approach from critical discourse studies, comparative analysis of the texts demonstrates how digital equity plans conceive of digital equity, characterize current problematic circumstances, and prescribe actions to make change. The plans have strikingly little to say about why digital inequality has emerged, yet they prescribe actions that indicate a more complex understanding of the problem than they articulate. The dynamics of policy diffusion suggest that the work of early adopters will influence other municipalities to create similar plans. Thus, the current moment is ripe for scholars to influence municipal planning for digital equity and participate in its discursive construction in both academic research and policymaking circles.

Farms Need Broadband

Today, broadband is a necessary tool to innovate farming practices, allowing for more targeted and efficient resource use. Farmers need connectivity in the farmhouse and farm office, in the field, and in the community to enable sustainable, data-driven agriculture and meet the world’s rising demand for food. This week we learned of the recommendations of a blue-ribbon panel created by Congress to address the connectivity needs of agriculture.

Public Knowledge and Benton Institute Urge Court to Uphold New York’s Affordable Broadband Act

Public Knowledge, joined by the Benton Institute for Broadband & Society, filed an amici curiae brief in the United States Court of Appeals for the Second Circuit, which is reviewing a New York law to make broadband internet more affordable. New York’s Affordable Broadband Act would require internet service providers (ISPs) to sell a $15-per-month broadband plan to low-income households. A group of ISP trade associations oppose the law, and sued New York’s Attorney General to prevent it from going into effect. A previous ruling by the District Court prevented New York from enforcing the Affordable Broadband Act, but the Court of the Appeals could reverse that decision. The brief supports New York’s position and explains how improving affordability–even just for some people–in fact helps everyone. The brief addresses how broadband access supports a strong economy, better public health outcomes, and improves educational opportunity, and also reviews recent empirical research into broadband affordability conducted by the Benton Institute.

Gov Pritzker Announces Accelerate Illinois Broadband Infrastructure Planning Program

Gov JB Pritzker (D-IL) and the Illinois Department of Commerce and Economic Opportunity (DCEO) Office of Broadband announced the Accelerate Illinois Broadband Infrastructure Planning Program. The program – a collaborative effort by the Illinois Office of Broadband, Illinois-based Benton Institute for Broadband & Society, and University of Illinois Extension – will help local governments throughout Illinois receive expert support as they prepare to leverage new dollars that will be made available by the state as well as through the historic passage of the federal infrastructure program. The collaboration opportunity is made possible through the financial support of Heartland Forward and its Connecting the Heartland Initiative. The Illinois Office of Broadband is calling on local units of government to apply to receive expert support offered as part of an intensive 14-week community engagement program designed to turn available public broadband funding into sustainable broadband access. The Accelerate Illinois program works to prepare communities for establishing and implementing a full-scale broadband connectivity vision. Through over 30 hours of no-cost expert counsel provided by the Benton Institute, the program offers structured engagement for communities to identify broadband goals, understand available funding options, and target capital dollars to support implementation. The Accelerate Illinois "Notice of Collaboration Opportunity" is open now and accepting applications through December 30, 2021. The State expects to serve up to 12 communities as part of this initial pilot initiative.

Comcast buys 2 small municipal internet businesses in Massachusetts

Braintree Electric Light Department (BELD) — a nonprofit, publicly owned power utility and broadband internet provider — announced it has sold its internet business to Comcast. The sales price was not disclosed. BELD said the deal will have no impact on its electric division. BELD’s approximately 2,500 internet and phone customers will have their service transferred to Comcast, beginning this year. Comcast has already been an incumbent provider in Braintree (MA) for 18 years. Comcast also announced it was buying Russell Municipal Cable TV in Springfield (MA). The city of Russell (population 1,800) has owned and operated the service since 1988. Terms of the deal with Comcast were not revealed. Comcast plans to transition residents and businesses to its Xfinity and Comcast Business suite of services through the end of 2021. It will offer its complete portfolio of Xfinity services, including Xfinity Internet, its X1 platform for video service, Xfinity Home security and automation services, Xfinity Voice and Xfinity Mobile.

Why we need 'meta jurisdiction' for the metaverse

As Meta, the multinational corporation formerly known as Facebook, and other technology companies prepare for their versions of the coming “metaverse,” it would be wise to figure out ahead of time the rules to be applied inside these virtual worlds. Too often, technology companies innovate first and then figure out the ethical conundrums, regulatory challenges and governance fixes, when it can be too late. Terms of service from Big Tech do not often protect basic human rights. If the metaverse is to unleash the full potential of the internet, it should not be stymied by nefarious actors, Big Tech, or self-interested states exercising digital realpolitik. Nor should the metaverse be bound by traditional notions of jurisdiction. Instead, we need “meta jurisdiction” for global rules that could be enforced by many stakeholders, not just states. Technologists, nongovernmental organizations and lawyers need to work shoulder to shoulder, all donning their headsets. By insisting that the founding tenets of the metaverse be centered around basic human rights, sustainable environmental protection and equitable labor standards, we can build a decentralized virtual world that brings out the best of humanity.

Lawmakers Introduce Bicameral Bill to Protect Consumers From Online Free Trial Scams

Sen Chris Van Hollen (D-MD) and Rep Yvette Clarke (D-NY) introduced the Consumer Online Payment Transparency and Integrity Act (S.3298), or Consumer OPT-IN Act, to protect consumers from online free trial scams and deceptive marketing tactics. To do this, the Consumer OPT-In Act will:

  • Require companies to get express informed consent from consumers before converting free trials into automatically renewing contracts and charging consumers;

  • Require companies to notify consumers of the first automatic renewal and obtain express informed consent from consumers before automatically renewing long term contracts;

  • Require that companies offering contracts that automatically renew on a short term basis get express informed consent from consumers annually;

  • Require companies that have knowledge that a consumer isn’t using their products or service for 6 months to get the consumer’s express informed consent to continue billing, and allowing consumers to request a refund for the remaining portion of the contract;

  • Provide consumers with refunds when violations occur;

  • Give the FTC rulemaking authority over negative option contracts, automatic renewals, and dark patterns.
