Windstream Chapter 11 Plan Withstands Bondholder Appeal
The Second Circuit Court of Appeals in New York upheld the chapter 11 restructuring of Windstream Holdings Inc., finding bondholder complaints about the debt-cutting plan moot because reversing it would mean unwinding transactions that have already taken place. The court backed Windstream's 2020 restructuring, which put Elliott Management Corp. and other senior creditors in control of the business while wiping out junior bondholders owed roughly $2.4 billion.

I’ve worked with a number of small communities that want to explore the idea of having a community-owned broadband provider. My advice to small communities is the same as with all clients – economy-of-scale really matters for providers. Economy-of-scale is the economic term for describing how businesses get more efficient as they get larger. A large percentage of the costs of operating a broadband provider is fixed or nearly fixed. Any fixed cost acts in the same manner as the general manager’s salary.

Electric co-ops are stepping up to close the digital divide. An effort in Virginia has connected 30,000 rural residents to the internet through fiber since 2017 and plans to hook up another 200,000 in the next three to five years. The work is being driven by the Virginia, Maryland, and Delaware Association of Broadband Cooperatives, which was established to provide a “singular, unifying voice for cooperative broadband interests.” Co-operatives are not driven by profits.

House approves antitrust bill targeting Big Tech dominance
The House of representatives approved antitrust legislation targeting the dominance of Big Tech companies by giving states greater power in competition cases and increasing money for federal regulators. The Merger Filing Fee Modernization Act passed by a 242-184 vote.
