Rural Digital Opportunity Fund

This week, the Federal Communications Commission established procedures for the first phase of the Rural Digital Opportunity Fund auction (Auction 904, if you're scoring at home).

As Virginians have been adapting to a new way of life during the coronavirus outbreak, high-speed internet access has become a necessity, now more than ever. The coronavirus emergency has only exacerbated the burden of internet insecurity and the consequences of inadequate access for rural Americans. That is why, in April, I wrote a letter to House and Senate leadership advocating for the inclusion of rural connectivity capabilities in future coronavirus stimulus packages, including key legislation that I have put forward in Congress. In March, I introduced the Serving Rural America Act.

The Federal Communications Commission has reversed course on whether to let SpaceX and other satellite providers apply for rural-broadband funding as low-latency providers. But FCC Chairman Ajit Pai said companies like SpaceX will have to prove they can offer low latencies, as the FCC does not plan to "fund untested technologies."  Chairman Pai's original proposal classified SpaceX and all other satellite operators as high-latency providers for purposes of the funding distribution, saying the companies haven't proven they can deliver latencies below the FCC standard of 100ms.

The Federal Communications Commission adopted procedures for Phase I of the Rural Digital Opportunity Fund (RDOF) auction (Auction 904), which will award up to $16 billion in support over 10 years for the deployment of fixed broadband networks to millions of unserved homes and businesses across rural America. The $20.4 billion RDOF is the FCC’s most ambitious step ever toward bridging the digital divide. It prioritizes bids for higher speed—up to 1 Gbps—and lower latency networks, and more than doubles the minimum speed from the FCC’s 2018 Connect America Phase II auction to 25/3 Mbps.

On April 3, 2020, Senator Ed Markey (D-MA) and Rep Anna Eshoo (D-CA) wrote to Federal Communications Commission Chairman Ajit Pai to ensure that as the FCC begins the mapping efforts required under the Broadband DATA Act (which President Donald Trump signed on March 23, 2020), that the FCC include community anchor institutions such as health care facilities, schools, and libraries.

Senate Commerce Committee Chairman Roger Wicker (R-MS) sent a letter to Federal Communications Commission Chairman Ajit Pai requesting information on accelerating the Rural Digital Opportunity Fund (RDOF) Phase I auction. The FCC plans to begin RDOF Phase I, which will make $16 billion available for broadband services, in October 2020. The letter reads, "[G]iven the current increased need for reliable internet during the pandemic, broadband funding, particularly through the RDOF program, may not come soon enough.

The Federal Communications Commission will hold an Open Meeting on Tuesday, June 9, 2020. Due to the current COVID-19 pandemic and related agency telework and headquarters access policies, this meeting will be in a wholly electronic format and will be open to the public on the Internet via live feed from the FCC’s web page and on the FCC’s YouTube channel.

Democratic congressional staffers are signaling fresh optimism that some money for broadband will make it into another coronavirus relief package long mulled on Capitol Hill. Republicans are “proceeding politically a little more cautiously right now” in deference to GOP leadership, but “we know privately that there are Republicans that would be very supportive of spending more money on E-Rate or Lifeline or Rural Healthcare,” said Joey Wender, senior policy adviser to Sen. Ed Markey (D-MA).

Rep Fred Upton (R-MI) and House Majority Whip James E. Clyburn (D-SC) announced the introduction of the “Rural Broadband Acceleration Act,” bipartisan legislation that directs the Federal Communications Commission to fund shovel-ready, high-speed internet projects immediately, so consumers can access broadband within a year.

Frontier told the Federal Communications Commission it would “welcome the inclusion” of the census blocks where it claims to newly offer broadband service into the upcoming Rural Digital Opportunity Fund (RDOF). Seeking to “clarify” its position, Frontier indicated that it would not fight to exclude the 17,000 census blocks in question despite maintaining that it does offer 25/3 Mbps speeds in those areas.
