LAWMAKERS MAY SEEK OVERHAUL AT FCC

Could 2008 be the year to reform the Federal=20
Communications Commission? Sen. John (Jay)=20
Rockefeller (D-WV) called for reauthorization=20
legislation that would examine the agency's=20
structure and mission, with the goal of making it=20
a stronger consumer advocate and "a better=20
resource for Congress." Analysts and watchdogs=20
said that a reauthorizing bill, which enables=20
Congress to restructure and reprioritize an=20
agency, would have repercussions whether or not=20
it gains momentum. "It doesn't have to be enacted=20
to make a lot of things happen," said Andrew=20
Schwartzman, president and CEO of the Media=20
Access Project. Blair Levin, managing director at=20
the investment firm Stifel Nicolaus, said 2008=20
would be an optimal time for action. "An election=20
year is a great year to do it because it doesn't=20
really have a partisan tint," he said, noting=20
that lawmakers won't know whether their measure=20
would impact a Republican- or=20
Democratic-controlled FCC in 2009. 1990 was the=20
last time a FCC reauthorization bill was enacted.

FCC VOTES FOR MONOPOLY, CONGRESS MUST VOTE FOR DEMOCRACY

[Commentary] The Federal Communications=20
Commission has, as expected, voted along party=20
lines to approve the demand of Rupert Murdoch and=20
other communications-industry moguls for a=20
loosening of limits on media monopolies in=20
American cities. Now, the real fight begins. FCC=20
Chairman Kevin Martin's move goes against every=20
signal the FCC has gotten from Congress, which is=20
responsible for establishing regulations=20
regarding the ownership of the public's airwaves.=20
A response must come from Congress. Before the=20
vote, 26 members of the Senate notified the=20
commission that they would "immediately move=20
legislation that will revoke and nullify the=20
proposed rule." But they will need the full and=20
aggressive support of Democratic leaders in the=20
Senate and House to push back with the force=20
necessary to counter an expected veto by=20
President Bush. This is one fight where citizen=20
action will matter. Key Republicans such as=20
Stevens and Mississippi's Trent Lott, the party's=20
number two man in the Senate, are in complete=20
support of the move to overturn the FCC vote. It=20
is possible to build a broad coalition. But there=20
can be no wavering by the Democrats on this=20
front. Indeed, they must make this a national=20
issue. And the way to do that is by talking it up=20
where it cannot be ignored. All four Democratic=20
senators who are seeking the presidency signed=20
the letter pledging to revoke and nullify the FCC=20
decision. Now, New York's Hillary Clinton,=20
Illinois' Barack Obama, Connecticut's Chris Dodd=20
and Delaware's Joe Biden need to put the issue of=20
media monopoly front and center in Iowa and New=20
Hampshire. If they are not talking about the=20
fundamental threat to diversity of media=20
ownership in American communities and the country=20
as a whole, they will be failing to use the most=20
powerful bully pulpit in the fight against the=20
monopoly on communication that represents the=20
single greatest threat to the battered democratic=20
discourse of a country where the public's right=20
to know cannot take this hit and survive.

their view that the Internet has come a long way=20

has since overtaken the old media, then they must=20
make sure the Internet functions as it should --=20
in the free, non-discriminatory and unencumbered=20
environment it has until now. The last thing this=20
country needs after the FCC allows the=20
traditional media to consolidate is for the=20
Commission to let the telephone and cable=20
companies exercise proprietary control over the=20
Internet, whether stopping or restricting certain=20
Internet applications (like BitTorrent) from=20
being used or functioning as copyright cops for=20
Hollywood, as AT&T wants to do. That said, we=20
look forward to the Commission acting on=20
petitions to protect the Internet from those who=20
would control it, and to the Commission coming up=20
with rules to make sure that the promise that the=20
majority saw yesterday will continue tomorrow.

Sen. Byron Dorgan (D-ND) -- with a second from=20
Sen. Jim Webb (D-VA) -- took to the Senate floor=20
Wednesday to harshly criticize the Federal=20
Communications Commission's Dec. 18 vote to=20
loosen newspaper-broadcast cross-ownership rules.=20
He called the Republican majority out by name and=20
pledged to introduce a "resolution of=20
disapproval" that he said would pass. The=20
resolution would invalidate the FCC's rule change=20
after it officially takes effect -- one of=20
several possible legislative attacks on the rule=20
change proposed by Democrats critical of=20
consolidation. Sen Dorgan talked of the=20
"unbelievable arrogance" of the FCC majority to=20
loosen the ban after the Senate Commerce=20
Committee passed a bill trying to block the vote=20
and 25 senators wrote FCC chairman Kevin Martin=20
warning him to delay the vote. Sen Dorgan said=20
the FCC, "with strings to the White House," is=20
pushing more concentration and "short-circuiting"=20
the comment process, when "that is the last thing in the world we need."

SMALL-MARKET TV STATIONS VOICE THEIR CROSS-OWNERSHIP GRIPES

A group representing small-market TV stations=20
said the FCC erred by not loosening the duopoly=20
rules to allow owners in smaller markets to own=20
more than one station. Paul McTear of Raycom=20
Media said the FCC "failed to take into account=20
evidence in the record regarding the harm that=20
the duopoly rule does to the ability of=20
television stations in smaller markets to serve=20
their communities," adding that he didn't see how=20
the decision -- which Martin said was based=20
partially on public input in media-ownership=20
hearings, as well as congressional criticism --=20
would satisfy the D.C. Circuit's remand of the=20
duopoly rule or the Philadelphia Federal Court's=20
instruction to look at "all of its ownership=20
rules to ensure that they remain in the public interest."

RADIO VETERAN EXPECTED TO PLAY A BIG ROLE AT TRIBUNE

Randy Michaels, a veteran broadcasting executive=20
with long-term ties to Sam Zell, will play an=20
important role at Tribune Co. after Zell, as=20
expected, takes over as chairman this week. He=20
probably focus on Tribune's broadcast and=20
interactive businesses. The company owns 23=20
television stations, including Superstation WGN,=20
and such interactive properties as CareerBuilder,=20
a rapidly growing help-wanted website. Most=20
recently, Michaels has been chief executive of=20
Local TV, a chain of nine mid-size Midwestern=20
television stations acquired in May with the=20
backing of Oak Hill Capital, a private equity=20
firm run by Fort Worth investor Robert Bass.=20
Under Michaels, the chain has emphasized live=20
local newscasts as audience builders. Michaels,=20
55, last worked for Zell at Jacor Communications=20
Inc., a radio chain Zell bought in 1993 and sold=20
at a huge profit in 1998 to Clear Channel=20
Communications Inc. He helped build Clear Channel=20
into a network of 1,200 stations coast to coast.=20
But he had also alienated record companies by=20
exploiting the company's market strength to build=20
its concert business, forcing the industry to do=20
business with both units. Critics also blamed him=20
for homogenizing local radio, a reference to=20
Clear Channel's use of disc jockeys operating out=20
of a centralized location but projecting the=20
impression that they were locally based. Although=20
Michaels helped implement the policy at Clear=20
Channel, it is not certain he originated it.

Intelsat's existing control group of four private=20
equity firms to Serafina, a newly-formed Bermuda=20
company indirectly controlled by BC Partners=20
Holdings Limited, a U.K.-based investment firm=20
organized under the laws of Guernsey, a British=20
Crown Dependency. Commissioner Michael Copps=20
said, "Today's decision substitutes one group of=20
private equity firms for another group of private=20
equity firms as owners of the world's largest=20
provider of fixed satellite services. While I=20
have no reason to believe that this latest group=20
of owners will operate the company with more or=20
less concern for the public interest than the=20

alternatives for the company," which will likely=20

from Nielsen, Pappas stations reach more than 16=20

addition, the company owns or operates television=20

FCC EXTENDS AUCTION-PAYMENT DEADLINE

The Federal Communications Commission gave=20
bidders in its upcoming spectrum auction another=20
week to make their upfront payments, correct=20
their applications and qualify to participate in=20
the Jan. 24 auction of 700 megahertz of spectrum=20
being reclaimed from broadcasters in the switch=20
to digital. Frontline Wireless asked for the=20
extension from Dec. 28, citing the holidays, and=20
the FCC complied, moving the date to Jan. 4. The=20
FCC said 266 applications were filed but only 96=20
were complete and accepted for filing. Those only=20
need to make their payments by Jan. 4 to be=20
eligible. The rest -- 170 of them -- will get=20
letters from the commission spelling out their=20
deficiencies. Those corrected applications must=20
be resubmitted along with payment by Jan. 4.=20
Google's application was in order, but among=20
those that still needed work were AT&T, Alltell, Cox Wireless and Qualcomm.

$10,000 FCC FINE FOR WLEX-TV LEXINGTON, KY

The Federal Communications Commission has fined=20
WLEX-TV in Lexington (KY) $10,000 for not putting=20
copies of its program/issues list in its public=20
file for an almost four-year stretch between 2001=20
and 2004. Stations are required to file a list of=20
the programs on issues of public importance they=20
have aired. The station told the FCC it=20
reconstructed the lists, filed them and took=20
steps to make sure it doesn't happen again. But=20
taking into account the number of missing files=20
and the length of the violation, the agency=20
concluded that it was willful and repeated and levied the fine.

SERVICE FUND FROM ANTIDEFICIENCY ACT

Congress approved a measure to exempt the=20
Universal Service Fund (USF) from the=20
Antideficiency Act (ADA) for another year. The=20
provision was included as part of an omnibus=20
appropriations bill (H.R. 2764) and would provide=20
relief from an accounting rule that would=20
otherwise delay important broadband funds from=20
being delivered to schools and libraries in a=20
timely fashion. This fix was first put in place=20
after application of the ADA resulted in millions=20
of dollars in delayed funding, which threatened=20
technology programs at countless schools across the nation.

DIRECTV TO CARRY PUBLIC TV STATIONS IN HD

10-year deal with the Association of Public=20

More television viewers are turning to the=20
Internet to watch videos, films and TV episodes,=20
according to a new survey. In the past year,=20
YouTube has widened its lead as the top=20
destination for online videos, while search=20
engines and television networks have gained=20
ground. Approximately 65 percent of the 2,455=20
U.S. adults surveyed by Harris Interactive said=20
they have watched a video on YouTube, compared to=20
42 percent during the same time last year. More=20
than one-third of viewers overall and half of=20
those 18 to 24 said there is something they=20
really enjoy about discovering a cool video online.

to a settlement worth $31.5 million to resolve=20
accusations that the companies promoted illegal=20
Internet gambling, the Justice Department said on=20
Wednesday. The companies were accused of=20
receiving money from online gambling businesses=20
to advertise illegal betting from 1997 through=20
2007. As part of the settlement, the companies=20
will pay cash to the U.S. government and provide=20
millions of dollars worth of public service=20
advertisements informing young adults and=20
teenagers that Internet gambling is illegal.

IRAQI MEDIA BRAVES ASSAULT FROM ALL SIDES

For the fifth year in a row, Iraq was the most=20
dangerous place in the world to be a journalist.=20
The New York-based Committee to Protect=20
Journalists reported this week that 31=20
journalists have died in 2007, one fewer than a=20
year ago. The media watchdog group said that 173=20
have died since 2003, including 49 media support=20
workers =96 the drivers, translators, and guards=20
who work for media companies and help report the=20
news. The vast majority of those killed are=20
Iraqis =96 who have not only been targeted by=20
insurgent groups but who also appear to be facing=20
a growing campaign of harassment, kidnapping, and=20
assault at the hands of government officials and=20
Iraqi politicians. Those working for print,=20
television, radio, and other outlets say they are=20
sometimes bribed to relay the views and=20
pronouncements of the organization that funds=20
their operations or paid off by politicians who=20
want positive coverage. Others say they face=20
ongoing pressure from the US military, as=20
illustrated by the case of award-winning=20

online teens =97 mostly girls =97 are super=20
communicators, adept with a wide variety of=20
tools. Teens' least favorite tool across the board? E-mail.
