Federal Communications Commission Chairman Tom Wheeler announced that the following items are tentatively on the agenda for the November Open Commission Meeting scheduled for Thursday, November 17, 2016:

Mobility Fund: The Commission will consider a Report and Order that would adopt rules for the second phase of the Mobility Fund, which would provide ongoing universal service support dedicated to expanding the availability of mobile broadband networks. (WT Docket No. 10-208; WC Docket No. 10-90)

Roaming Obligations of Commercial Mobile Service Providers and Regulatory Classification of Voice over LTE Service: The Commission will consider a Notice of Proposed Rulemaking that would seek comment on proposals to implement a unified roaming standard and to classify Voice over LTE. (WT Docket No. 16-356)

Business Data Services: The Commission will consider a Report and Order and Second Further Notice of Proposed Rulemaking that would allow for light-touch regulation of packet-based Business Data Services and retain and update price cap regulation for lower-bandwidth TDMbased Business Data Services to ensure that lack of competition does not unfairly harm commercial customers or the consumers who rely upon these services. Video Description: Implementation of the Twenty-First Century Communications and Video Accessibility Act of 2010: The Commission will consider a Report and Order which addresses the amount of video described programming required to be made available to consumers. (MB Docket No. 11-43)

Federal Communications Commission Chairman Tom Wheeler announced that the following items are tentatively on the agenda for the October Open Commission Meeting scheduled for Thursday, October 27, 2016:

  1. Protecting the Privacy of Customers of Broadband and other Telecommunications Services: The Commission will consider a Report and Order that applies the privacy requirements of the Communications Act to broadband Internet access service providers and other telecommunications services to provide broadband customers with the tools they need to make informed decisions about the use and sharing of their information by their broadband providers. (WC Docket No.16-106)
  2. Deceptive Marketing: The Commission will separately consider four Memorandum Opinions and Orders that dismiss and deny Petitions for Reconsideration of four Forfeiture Orders issued by the Commission for the deceptive marketing of prepaid calling cards.

Federal Communications Commission Chairman Tom Wheeler announced that the following items are tentatively on the agenda:

  1. Improving Wireless Emergency Alerts (WEA): The FCC will consider a Report and Order and Further Notice of Proposed Rulemaking that would leverage advancements in technology to improve wireless emergency alert content, delivery and testing, while seeking comment on further measures to ensure effective alerts. (PS Docket No. 15-91)
  2. Review of Foreign Ownership Policies: The FCC will consider a Report and Order that extends to broadcast licensees the same streamlined rules and procedures that common carrier wireless licensees use to seek approval for foreign ownership, with appropriate broadcast-specific modifications. The item also establishes a framework for a publicly traded common carrier or broadcast licensee or controlling U.S. parent to ascertain its foreign ownership levels. (GN Docket No. 15-236)
  3. Independent Programming: The FCC will consider a NPRM that proposes steps the Commission can take to promote the distribution of independent and diverse programming to consumers. (MB Docket No. 16-41)
  4. Expanding Consumer Choice: The FCC will consider a Report and Order that modernizes the Commission’s rules to allow consumers to use a device of their choosing to access multichannel video programming instead of leasing devices from their cable or satellite providers. (MB Docket No. 16-42)

Implementation of the Twenty-First Century Communications and Video Accessibility Act of 2010, Section 105, Relay Services for Deaf-Blind Individuals: The FCC will consider a Report and Order that would convert the National Deaf-Blind Equipment Distribution Program from a pilot to a permanent program. (CG Docket No. 10-210)
  2. Improvements to Benchmarks and Related Requirements Governing Hearing Aid-Compatible Mobile Handsets: The FCC will consider a Report and Order that would implement changes to the scope of the wireless hearing aid compatibility rules. (WT Docket No. 15-285)
  3. Ensuring Just, Reasonable, and Fair Rates for Inmate Calling Services: The FCC will consider an Order on Reconsideration, responding to a petition filed by Michael S. Hamden, that would ensure that the rates for Inmate Calling Services (ICS) are just, reasonable, and fair and explicitly account for facilities’ ICS-related costs. (WC Docket No. 12-375)

Spectrum Frontiers – The Commission will consider a Report and Order and Further Notice of Proposed Rulemaking that would make spectrum in bands above 24 GHz available for flexible use wireless services, including for next-generation, or 5G, networks and technologies. Advancing Technology Transitions – The Commission will consider a Declaratory Ruling, Report and Order, and Order on Reconsideration that adopts a framework to guide transitions to next-generation communications technologies while protecting the interests of consumers and competition. Reforming Executive Branch Review Process of Certain FCC Applications and Petitions Involving Foreign Ownership: The Commission will consider a Notice of Proposed Rulemaking that seeks comments on changes to streamline and increase the transparency of the Executive Branch review of applications and petitions for national security, law enforcement, foreign policy and trade policy concerns. (IB Docket No. 16-155)

Adding Hurricane-Related Event Codes to the Emergency Alert System: The Commission will consider a Report and Order that would revise the Emergency Alert System rules by adding new event codes covering extreme high winds and storm surges caused by Category 3 (and greater) hurricanes. (PS Docket No. 15-94)

Improving Outage Reporting for Submarine Cables: The Commission will consider a Report and Order to require submarine cable licensees to report communications network outages to the FCC. (GN Docket No. 15-206)

Expanding Access to Video Programming for Blind or Visually Impaired Americans: The FCC will consider a Notice of Proposed Rulemaking that seeks comment on proposals to expand the amount of and access to video described programming, for the benefit of consumers who are blind or visually impaired.   2. Providing Affordable Broadband for Low-Income Americans: The FCC will consider a Third Report and Order, Further Report and Order, and Order on Reconsideration to comprehensively restructure and modernize the Lifeline program to efficiently and effectively connect low-income Americans to broadband, strengthen program oversight and administration, and take additional measures to eliminate waste, fraud, and abuse.   3. Protecting the Privacy of Customers of Broadband Services: The FCC will consider a Notice of Proposed Rulemaking seeking comment on a proposed framework for ensuring that consumers have the tools they need to make informed choices about how their data is used and when it is shared by their broadband providers. The Federal Communications Commission will hold an Open Meeting on Thursday, February 18, 2016. The FCC will consider:

  1. A Notice of Inquiry that seeks comment on the current state of programming diversity and the principal obstacles that independent programmers face in obtaining carriage on video distribution platforms
  2. A Notice of Proposed Rulemaking that seeks comment on a framework for providing innovators, device manufacturers and app developers the information they need to develop new technologies to access video content A Second Report and Order that allocates responsibilities for the delivery of closed captions on video programming and the handling of captioning complaints.

There’s also three enforcement items on a consent agenda if you’re planning on bringing the kids.
