Don’t Make Applying for E-rate Fiber Even Harder

Applying for E-rate funding is not simple, especially for applicants seeking fiber-based services. Applicants must have an in-depth knowledge of dark vs. lit fiber, self-provisioning, and special construction, and that’s just the beginning. The vast majority of schools and libraries have to hire consultants to guide them through the labyrinth of E-rate rules and procedures. So the last thing we should want is to make the E-rate application even more difficult. Unfortunately, that is exactly what is happening.

E-rate fiber applications are being delayed or denied even though they follow the Federal Communications Commission’s policies, past precedent, and the Eligible Services List (ESL). As a membership organization made up of schools, libraries, associations, broadband companies and E-rate consultants, we hear these complaints constantly. The Schools Health and Libraries Broadband Coalition (SHLB) will file comments later this week on the proposed ESL for Funding Year 2018 asking to maintain the existing rules and policies governing applications for fiber-based services. The rules and policies adopted in the 2014 E-rate Modernization Orders are intended to help schools and libraries increase their bandwidth and obtain low-cost fiber services, which will be especially helpful in rural markets. We will encourage the FCC to maintain the 2014 rules and policies and to provide consistent guidance to E-rate applicants.

Program for rural internet in schools, libraries in jeopardy

[Commentary] The federal E-rate program plays a critical role in allowing Kansas kids to harness the power of technology in schools and libraries. Current Federal Communications Commission Chairman Ajit Pai has voiced support for the program as a commissioner, repeatedly calling it a “program worth fighting for” and saying it has the potential to “help millions of children in America benefit from digital learning.” Of course, we agree with him on those points. However, since then, Chairman Pai has curiously refused to commit to protecting the program; retracted a progress report demonstrating E-rate’s success following its modernization; and expressed a desire to alter funding for the program in a way that would leave countless kids behind.

With Chairman Pai scheduled to testify to the Senate Commerce Committee, Sen Jerry Moran (R-KS) has an important opportunity to stand up for kids in Kansas and throughout the country. School districts like Garden City, which received $492,000 in funding in 2016 to expand access to high speed internet services thanks to E-Rate funding. We respectfully urge Sen Moran to stand up for our nation’s schools on July 19.

To Close Digital Divide, Microsoft to Harness Unused Television Channels

Microsoft will harness the unused channels between television broadcasts, known as white spaces, to help get more of rural America online.

In an event at the Willard Hotel in Washington, where Alexander Graham Bell demonstrated a coast-to-coast telephone call a century ago, Microsoft plans to say that it will soon start a white-spaces broadband service in 12 states including Arizona, Kansas, New York and Virginia to connect two million rural Americans in the next five years who have limited or no access to high-speed internet. Microsoft’s president, Brad Smith, said white spaces were “the best solution for reaching over 80 percent of people in rural America who lack broadband today.” To support the white-spaces plan, Microsoft is appealing to federal and state regulators to guarantee the use of unused television channels and investments in promoting the technology in rural areas. But the company faces many hurdles with the technology.

Microsoft said its goal was not to become a telecom provider. It will work with local internet service providers like Mid-Atlantic Broadband Communities in Virginia and Axiom Technologies in Maine by investing in some of the capital costs and then sharing in revenue. It has also opened its patents on the technology and teamed with chip makers to make devices that work with white spaces cheaper.

As the Digital Divide Grows, An Untapped Solution Languishes

Too many students still scrounge for the vital internet access their classmates (and technology-enamored school reformers) take for granted. Dozens of interviews—along with reviews of tax disclosures, Federal Communications Commission filings, and court records related to the Educational Broadband Service (EBS)—show that this educational spectrum is, at least, woefully underutilized. It's a public resource born of good intentions but wasted by a broken system.

There are lots of ideas for fixing EBS. JH Snider of iSolon said the FCC could reclaim leased EBS licenses when they expire and reallocate them, although he can’t imagine them taking such a bold step. The FCC could also issue new spectrum licenses for the rural areas not yet covered by EBS, under the condition that license holders use the spectrum for public purposes rather than lease it. The national association of EBS license holders sent the FCC a proposal along these lines in 2014, but the agency has not formally responded. As for the current leases that dominate EBS, EveryoneOn founder Zach Leverenz said that the FCC could do a lot to “correct the shadiness in the system” just by clarifying the vagueness of legacy rules tying EBS to its original mission—such as defining what 20 hours per week of educational use means and ensuring that the 5 percent of spectrum “reserved” from the leases is actually used for educational purposes.

Australian internet slow and plagued by disconnections, survey finds

Australia is plagued by internet disconnections, drop-outs and slow download speeds, a survey has found.

The Choice internet satisfaction survey found six in 10 Australians have had issues with their service in the past six months. More than 75% of national broadband network customers surveyed said they had had problems, while more than 80% of ADSL and ADSL2 users listed varying speeds and connection issues.

“To make matters worse, some of the slowest providers also scored poorly when it comes to value for money and customer and technical support,” said Choice’s chief executive, Alan Kirkland. Telstra, Australia’s largest internet service provider, ranked last for value for money. The company’s customer and technical support also scored below the average.

More than 1,000 income-subsidized housing units in San Francisco are getting free gigabit internet

When residents at San Francisco’s Hunters Point East and West low-income, federally-subsidized housing complex went online, many had access to free gigabit speed internet for the first time.

This isn’t wi-fi that’s shared throughout the building, but rather each individual unit is getting its own internet connection. Hunters Point is the first housing development to get the service, where nearly 300 people live across 212 units in 27 buildings. But by the end of 2018, more than 1,000 additional units of San Francisco income-subsidized housing will receive free gigabit internet, servicing nine more developments in the Tenderloin neighborhood and four more in the Bayview area. The internet provider behind the effort is local San Francisco outfit Monkeybrains, a company that specializes in fast internet transmitted through wireless antennas. Instead of breaking up a sidewalk to lay fiber or cables, Monkeybrains beams high-speed internet through antennas installed on rooftops. For the Hunters Point buildout, technicians are stringing cable from the rooftop antennas to connect every unit.

FCC 'Lifeline' Program Opponents Wage War on the Poor

In its analysis of data from 2012 through 2014, the Government Accountability Office was unable to confirm the eligibility of 30 percent of Lifeline users it examined. Opponents hail this finding as proof of widespread fraud. However, the GAO didn’t determine that these individuals were ineligible; it was simply unable to verify whether providers had complied with eligibility guidelines. The GAO also conducted undercover investigations, submitting a total of 21 Lifeline applications using false information and fabricated supporting documents. Investigators were able to secure service from 12 of the 19 Lifeline providers. Notably, the GAO underscored that the tests were “for illustrative purposes to highlight any potential internal control vulnerabilities and are not generalizable.”

Although investigators were able to leverage their expertise to deceive certain Lifeline providers, the GAO itself admits this effort doesn’t prove that the program is plagued by fraud. But none of that will stop Lifeline critics — including Federal Communications Commission Chairman Ajit Pai — from using the GAO report to intensify attacks on the program and malign its users. They will continue to dismiss the tremendous opportunities Lifeline has provided for millions of people — and the millions more whose lives can be improved with Lifeline’s new broadband offerings.

FBA Files Comments on Accelerating Broadband Deployment

The Fiber Broadband Association commended the Federal Communications Commission’s efforts towards removing regulatory roadblocks to nationwide broadband deployment. FBA also offered significant barrier-reducing steps to help make that happen. First, FBA suggested that the Commission should amend its pole attachment rules to address practices of many pole owners and existing attachers that delay and increase the cost of access. Second, FBA urged the Commission to repeal the 2015 network change notification rule, which imposes an unnecessary and costly process, thereby hindering investment in fiber infrastructure. Third, FBA proposed that the Commission adopt criteria that can be used to readily determine which state and local laws and regulations violate Section 253 of the Communications Act and inhibit broadband deployment.

New report swings and misses on communities and next generation broadband

[Commentary] What is the role of cities in assuring that their residents have the affordable bandwidth necessary to thrive in the 21st century information economy? Municipal governments—more than other jurisdictions—will directly affect the cost of deploying fiber, the foundation for the abundant bandwidth that will serve next generation networks like 5G Mobile and the Internet of Things. Yet with a huge range of choices on how to influence their local broadband market, governments can struggle to understand how best to proceed. Into that breach arrives a new report entitled “Municipal Fiber in the United States: An Empirical Assessment of Financial Performance” by Christopher S. Yoo and Timothy Pfenninger of the University of Pennsylvania. Its stated purpose is to help municipalities by filling an “information gap by conducting a systematic analysis of every municipal fiber project in the United States.” Critically, the report concludes that the projects are money losers. I’m certain the report will provide sound bites for opponents of such projects. Unfortunately, for municipal leaders seeking a map for the path forward, it is both largely irrelevant and misleading. It’s a shame that the authors narrowly focused their gaze on Excel spreadsheets while ignoring how markets and communities are responding to the need for more abundant bandwidth. The report’s core message—which can be summarized as ‘let them eat DSL’—is one that does not deserve serious attention from cities.
