Texas Lawmakers Pass Opt-Out Privacy Bill

Montana Enacts Opt-Out Privacy Law

Governor Greg Gianforte (R-MT) has signed a privacy law that gives state residents new rights to wield control over data about them, including the right to reject some forms of online behavioral advertising. Senate Bill 384 provides that residents can opt out of the use of data linkable to them—including pseudonymous data, such as information stored on cookies—for targeted ads.

Maryland Supreme Court Urged To Strike Down Digital Ad Tax

Comcast and Verizon urged Maryland's highest court to strike down a 2021 law that imposes a tax on some digital ads, arguing both that the statute violates the Constitution, and that it conflicts with a 1998 federal law. The hearing centered on a 2021 Maryland law that imposes taxes on some online companies with more than $100 million in digital ad revenue.

NAD Recommends T-Mobile Discontinue “Don’t You Worry ‘Bout Speed” Claim for T-Mobile Home Internet Service

In a Fast-Track SWIFT challenge brought by Comcast, the National Advertising Division (NAD) of BBB National Programs recommended that T-Mobile discontinue the “Don’t you worry ‘bout speed” claim in reference to T-Mobile’s Home Internet (T-HINT) service. NAD determined that T-Mobile’s unqualified claim conveys the message that internet speeds are sufficient to provide worry-free internet service that will allow users to perform nearly all typical activities on the internet, including intensive uses like gaming or streaming on multiple devices at any time of day.

Charter can keep downstream speed claim, ad watchdog rules

Charter Communications came out on top in the latest advertising claim challenge lodged by AT&T. In its response to a challenge plaint from AT&T, the National Advertising Division (NAD) announced that Charter substantiated its "most consistent download speeds" claim for its Spectrum-branded broadband service. AT&T used an expedited challenge process, dubbed Fast-Track SWIFT, to bring this "single-issue" ad case to the NAD.

With fraud on social media surging, the Federal Trade Commission (FTC) has issued orders to eight social media and video streaming platforms seeking information on how these companies scrutinize and restrict paid commercial advertising that is deceptive or exposes consumers to fraudulent healthcare products, financial scams, counterfeit and fake goods, or other fraud.
